TERMS AND CONDITIONS


  • ALL CITY OF SPRING HILL PARKS ARE OPEN FROM DAYLIGHT TO DARK UNLESS POSTED OTHERWISE
  • NO ALCOHOLIC BEVERAGES OR TOBACCO PRODUCTS IN ANY CITY OF SPRING HILL PARKS
  • PETS MUST BE ON A LEASH AT ALL TIMES AND PET WASTE MUST BE DISPOSED OF
  • AMPLIFIED OR LOUD MUSIC IS PROHIBITED WITHOUT A PERMIT FROM THE PARKS DEPARTMENT
  • VENDORS, SOLICITING, SIGNS OR OTHER ADVERTISEMENTS ARE PROHIBITED WITHOUT APPROVAL
  • OPEN FIRES ARE PROHIBITED OTHER THAN COOK GRILLS FOR COOKING PURPOSES
  • SHELTERS MUST BE CLEANED AFTER EACH USE
  • ALL TRASH MUST BE DISPOSED OF PROPERLY
  1. User shall have the right to enter, occupy, and use specified areas of the Facility and mutually agreed upon areas of the Facility such as the restrooms, etc., before, after, or during the specified time of the function.  This includes setup and teardown time for the event as well as the event itself. 
  2. Facilities shall be surrendered to the City by User in the same condition as they were presented upon commencement of the event.  In the event that through the negligence or malicious acts of a User employee, representative, volunteer, or Event participant, damage is caused to the facilities that is determined by both parties to be above and beyond what is reasonable, User shall reimburse the City for all expenses and/or costs necessary to remedy said damage(s) which are caused by such negligent or malicious acts of User.
  3. No alterations shall be made to the Facility.
  4. Any equipment needed, or specific room or grounds setup shall be communicated to the City fourteen (14) days prior to the event date.  There may be additional cost for same, which shall be agreed upon beforehand between User and City. 
  5. User may cancel this contract with written notice provided to City at least ten (10) days prior to the event.
  6. User agrees to indemnify, hold harmless and defend the City (its officers, employees, agents, representatives, volunteers and assigns) against any and all claims, costs (including reasonable attorney’s fees), demands, causes of action, suits, injuries, damages of any kind whatsoever, loss or death resulting from User’s negligence, misconduct, malicious actions, or omissions.
  7. Any controversy relating to this Agreement or the transactions contemplated hereunder shall be governed by the laws of Tennessee in the Circuit Court for Maury County, Tennessee.
  8. Either party’s failure to enforce any provision or term of this Agreement shall not be construed as a future or continuing waiver of such provision or term of this Agreement.
  9. In the event any provision or portion of this Agreement is held to be invalid or unenforceable for any reason, such invalidity or unenforceability will attach only to such provision or portion of provision and will not affect or render invalid or unenforceable any other provision of this Agreement.

This Agreement sets forth the entire Agreement and understanding between the parties pertaining to the subject matter and merges all prior discussions between them on the same subject matter.  This Agreement may only be modified by a written document signed by duly authorized representatives of the parties.
